TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRAETA LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, or use
• Business interruption
• Personal injury or property damage
• Any damages arising from your use of the Service

OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

Before filing any lawsuit, you agree to first contact us to attempt informal resolution. If informal resolution fails, disputes will be resolved through binding arbitration under the rules of the American Arbitration Association.

The App, including all content, design, and software, remains the property of Traeta Inc. You receive only a right to use the App—not ownership of any intellectual property.

14.4 User Content and Data

You retain all rights to the personal data and content you connect to or generate through Traeta.

14.5 Restrictions

You may not:

• Copy, modify, reverse-engineer, or distribute the App.

To the fullest extent permitted by law, Traeta Inc. is not liable for any indirect, incidental, or consequential damages arising from use of the App.

We may update this Agreement from time to time. Continued use of the App after updates constitutes your acceptance of the revised terms.

14.10 Governing Law

This Agreement is governed by and construed under the laws of the State of California, United States, without regard to conflict-of-law principles.

16. Entire Agreement
